Gerry Bassermann, Director of North American Markets for Propellerhead Software, responded to our commentary about Recycle:

"Contrary to your thoughts, Recycle still sells well and is a leader in its category. We're steadily gratified by its popularity and usefulness."

We didn't state that the product was not "useful." However, for a one-dimensional product who's feature set has now been incorporated into other products, the $249 price point is extremely high.

Even if the design registrations of 6 subjects microphones are cancelled, the authorship belonging to Mr. Juris Zarins has been announced with the OHIM registrations to the third parties. These entries in the OHIM design register are still available and nobody has objected that the authorship to the subject 6 designs belongs to Mr. Juris Zarins. It means that in the EU the authorship with respect to these microphone designs are announced to the third parties and such information will be available as far these rights are in force. The cancellation of the microphone design does not affect the authorship announced to the third parties.
Such position is in conformity with general principles of copyright law in force in Latvia and also in the European Community. To obtain the right to use a work, it is necessary for the user of the work, for each type of use and each time it is to be used, to receive the permission of the rightholder to the use of the work. It is prohibited to use works if permission of the rightholder has not been received. Copyright and neighbouring rights objects protected in Latvia which have been imported from countries where such works are not protected by copyright or where the term of protection has expired shall also be deemed to be infringing copies.
6 subject microphone designs are the property of the company Scruples because the design of these microphones were created in our company. Blue produces illegal copies of our microphones without any permission of the right owner. In spite of our several polite requests to stop the distribution of Blue microphones, which are illegal copies of our microphone design, they continue receiving and selling Blue microphones thus infringing our rights. We would highly appreciate to receive their comments or explanations about any reasons allowing them to sell such counterfeited goods.

If they keep up this customer service, the Sirius subscriber base might dwindle.

My 2 cents about Sirius warranty replacement, a bad experience.

I have been a happy Sirius subscriber up until 2 months ago. I have Sirius in my car, which was given to me for free with its purchase. I was very happy with it, so I purchased a Sirius StarMate ST2 Replay for my father. He bought the home kit, and started having issues with reception on the Sirius StarMate ST2 Replay. After a few tests with his unit next to my car, we realized that it should be working properly, as my car was recieving signal correctly.

NOW THE FUN BEGINS!

After searching for a working number, as the one in the warranty book (888-869-5690) was wrong, I got a live warranty representitive. The telephone number for Sirius warranty is 866-257-7726 Monday through Saturday 8-10 EST I think. Sara was friendly an explained that they did not have any availible units to replace the defective one, and they would call me in two weeks. They also stated they would put the account associated to that SID on hold, as not to be billed.

2 weeks go by, then 3, and them my wife calls. "I can't login to Sirius online to listen to the radio at work" First thought, girls and technology, a fine match! (ladies don't hate me, but it's true). I tried to log in myself, and was notified about an issue with my account not be paid. Wonderful. Well I needed to call them anyway to find out about the defective Sirius StarMate ST2 Replay, so here I go. I will email them instead, busy at work, below is the reply:

Dear Brian,

Thanks for letting us know your concerns regarding the shipping delay of your replacement Starmate equipment. Please accept our apologies for any inconvenience you may have experienced. Our Warranty department is working diligently to get your replacement to you as quickly as possible.

- Press option#1

- Next press option#6 to change the status of your account

When you contact this department, be sure to inquiry about the free radio promotion!

Should you have any questions, or require further assistance with your Warranty claim, please do not hesitate to contact the Warranty department. They will be able to provide you with any information regarding your replacement radio. We listed Warranty's number below:

SIRIUS Customer Care

SIRIUS Satellite Radio, The Best Radio on Radio.

OK, I thought the account was put on hold already. I will call in now. This time they couldn't even give my the old "we'll call you in 2 weeks" lie, but they did credit the account $20 dollars, and correct the temporary hold on the account.

NOW THE FUNNY PART,

If you read in the email i posted above they mention a "free radio offer", interesting....

At the end of the above phone call the gentleman mentions, "hey, would you like to here about our free radio offer?" Go ahead Mr. customer service savant, enlighten me. (see I am getting frustrated even typing this!)

Long story short, they will give you a free radio if you prepay 6 months, and buy a home kit or boombox.

Hey, I wonder if the free radio they offer is the one I have been waiting for, and by reading some other posts what others have been waiting for also.

AND GUESS WHAT, they offer an Sirius StarMate ST2 Replay for free!

Conclusions:

I find it interesting how they can offer the radio I have been waiting for, under the "free radio program", but are unable to replace my defective unit. I know it is important to try an increase the subscriber base, but isn't it a catch 22 that by making current subscribers unhappy. I guess in the long run shareholders/market looks at new activations mostly. Ahhh, corporate America at its finest.....

I just can't understand why Apple would try and punish its fanbase. These are the sites that supported the company during very lean times and now Apple is stabbing them in the back. Doesn't the company have better things to do with its resources?
